What Should I Do
Immediately After an Uber Accident?
Your first concern should be safety. If anyone may be seriously hurt, call 911. If emergency personnel recommend that you be evaluated or transported, make the decision based on your medical condition and safety—not simply on concern about the cost of an ambulance or emergency-room visit. If you are dizzy, confused, in significant pain, having difficulty moving, or experiencing symptoms that could make driving unsafe, do not try to drive yourself.
If you can safely do so, preserve the basic information that identifies the ride and the vehicles involved. That can include the Uber trip receipt, the driver’s name and photograph, vehicle make and model, license plate, pickup and destination information, screenshots of the trip, photographs of the vehicles and scene, witness information, and messages connected with the ride. When speaking with the investigating officer, provide accurate facts about what you actually remember. Do not guess or speculate about details you are unsure of, and do not make legal conclusions about fault.

Should I Speak With Uber or an Insurance Adjuster After the Accident?
Before giving a detailed statement about how the crash happened, your physical condition, your medical history, or settlement, speak with Kurzman Law Group. Who Pays If My Uber Driver
Caused the Accident?
One of the first questions is what the Uber driver was doing in the app when the crash occurred. Florida law distinguishes between a driver who is simply logged into a transportation network company’s digital network and a driver who is engaged in a prearranged ride. A prearranged ride begins when the driver accepts the rider’s request through the app, continues while the driver transports the passenger, and ends when the last passenger exits the vehicle.
Under Florida Statute §627.748, Florida requires at least $1 million in primary automobile liability coverage for death, bodily injury, and property damage during the statutory prearranged-ride period.
That does not mean every Uber accident is worth $1 million. Insurance limits and case value are completely different things. The value of a claim depends on the injuries, medical treatment, future needs, lost income, legal responsibility, available evidence, and other circumstances. But identifying the correct insurance is a critical first step, and that requires determining whether the driver was logged into Uber, whether a ride had been accepted, whether the driver was on the way to pick up a passenger, whether a passenger was already inside the vehicle, and whether another driver or policy is also involved.
You do not have to determine which Uber policy applies before calling us. That is part of what we investigate.
What If the Uber Driver Was Logged In
but Had Not Accepted a Ride?
Florida law treats this period differently from an accepted Uber ride. When a driver is logged into the transportation network company’s digital network but is not yet engaged in a prearranged ride, Florida law requires lower primary liability limits than during the accepted-ride period: at least $50,000 for death and bodily injury per person, $100,000 per accident, and $25,000 for property damage. The statute also addresses PIP and uninsured/underinsured motorist coverage during this period.
That is why the driver’s app status cannot be treated as a minor technical detail. A driver saying “I was working for Uber” does not necessarily answer the insurance question. We need to know what the app and trip records show was happening at the moment of the crash.
What If the Uber Driver Was Offline?
If the driver was completely offline and not using the Uber platform at the time of the accident, Uber states that the driver’s personal automobile insurance generally applies. Uber’s own insurance information distinguishes among drivers who are offline, online and waiting for a trip, en route to a passenger, and on a trip.

That means a person can regularly drive for Uber but still be involved in an accident that has nothing to do with Uber insurance. Kurzman Law Group investigates the actual app status rather than relying simply on the driver’s occupation or what someone says at the scene.
What If Another Driver Caused the Crash
While I Was Riding in an Uber?
You may be an innocent Uber passenger caught between two drivers arguing over who caused the accident. Another vehicle may rear-end the Uber, run a red light, make an improper left turn, move into the Uber’s lane, fail to stop at a stop sign, or trigger a multi-vehicle collision. The other driver’s liability insurance may become an important source of recovery, but the analysis should not necessarily stop with that driver’s insurance card.

You do not need to be an Uber passenger to have an Uber-related accident claim. The driver’s app status may affect which insurance applies.

Florida law generally requires you to receive initial medical care within 14 days after a motor-vehicle accident. What Should I Save From the Uber App?

Florida’s TNC statute also requires an electronic receipt after completion of a ride containing specified trip information.

Airport Uber accidents can present unusual circumstances. Drivers may be monitoring the app, looking for a passenger, trying to locate a pickup zone, merging between terminal traffic, changing lanes, stopping for passengers, entering or leaving the airport, or navigating an area they do not regularly drive. An accident can happen while the driver is approaching the airport, traveling to the passenger, transporting the passenger away from FLL, or navigating the pickup area.
