One of the most commonly asked questions among my clients is “Who will fix my car after the accident?” Let me briefly answer this question and explain how it works.
If a negligent driver damages your car, you have two ways to proceed.
Through Your Carrier
You can have your own insurance company fix your car. Although your carrier will process your claim right away, you will be responsible for your out-of-pocket deductible. As soon as your carrier receives reimbursement from the negligent driver’s carrier though, you can collect your deductible back. This is known as “subrogating your deductible.”
Through Negligent Driver’s Carrier
The other option is to have the negligent driver’s insurance company fix your car if their insured was negligent. First, the carrier will have to comply with their internal protocol and investigate your claim. Subsequently, they will inspect your car and create a repair estimate. Finally, once they establish the auto repair costs, they will mail you or your car repair shop a check for that amount.
